Terms of Service
These Terms of Service (“Terms”) are the agreement between you and Sunvia (operated by Saqib Aziz as an individual developer based in Pakistan, hereinafter “we”, “us”, “Sunvia”) for your use of the Sunvia mobile application and any related services (collectively, the “Service”).
By creating an account, downloading, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
Who can use Sunvia
What Sunvia does
Sunvia reads data from your solar inverter through third-party APIs (currently SolarMan), records the data, and runs a rules engine that suggests favourable times to run heavy appliances. It also sends push notifications when one of those rules fires.
Your account and inverter credentials
Acceptable use
You agree not to:
License grant
Subject to your compliance with these Terms, Sunvia grants you a personal, worldwide, non-exclusive, non-transferable, and non-sublicensable license to access, install, and use the Service for the duration that your account is active. Sunvia (Saqib Aziz) is the licensor of the Service; the upstream API provider (SolarMan / IGEN Co. Ltd.) is not a party to this agreement between you and us.
Intellectual property
We retain all intellectual property rights in the Sunvia application, including its source code, design, brand, and the rules engine. You retain ownership of the data your inverter produces. You grant us only the limited license required to store, process, and display your data inside the Service.
Service availability and changes
Disclaimers
Sunvia's suggestions are advisory only. Decisions about running appliances, modifying your electrical setup, or trusting specific readings are yours. We disclaim all warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not responsible for damage caused by following the app's suggestions, by inaccurate readings from your inverter, or by acts of any upstream provider.
Limitation of liability
To the maximum extent permitted by law, Sunvia's total liability to you for any claim arising from or relating to the Service is limited to the greater of: (a) the fees you have paid us in the twelve months immediately preceding the event giving rise to the claim, or (b) USD 50. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, business interruption, or loss of reputation, even if advised of the possibility of such damages.
Termination
Third-party services
The Service depends on SolarMan's API (operated by Wuxi IGEN Co. Ltd.) for inverter data, on Supabase for database and authentication, and on Google Firebase Cloud Messaging / Apple APNs for push delivery. Their respective terms also apply to your use of those parts of the Service. If any of these providers ceases service, we will attempt to migrate to an alternative or notify you and refund any prepaid fees on a pro-rata basis.
Governing law
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law principles. The courts at Lahore, Pakistan have exclusive jurisdiction over any dispute arising from these Terms, except that we may seek injunctive relief in any competent court to protect our intellectual property.
